What the Florida court charges to file

These are the court’s own fees, paid to the clerk of court — never to us. They are separate from any service fee for preparing your documents.

Petition for Dissolution of Marriage Every case $408.00 Every Florida divorce. Set by Florida statute (§ 28.241), so it is the same in all 67 counties — simplified and regular dissolutions alike. Non-refundable, even if you reconcile and dismiss.
Summons — preparation $7.00 Only if your spouse must be formally served. Skipped entirely when they sign an Answer and Waiver of Service.
Summons — issuance $10.00 Charged per person served, again only where a waiver is not signed.
Being sworn in by a deputy clerk $3.50 Per signature, if you sign at the courthouse instead of before a notary. Our packages include online notarization, so this normally does not arise.
Certified / additional copies $1.00 Per page. You will usually want at least one certified copy of the Final Judgment for changing names and records.
Service by publication Set by the newspaper Only for a missing-spouse divorce, where Florida requires notice to be published. The newspaper sets this charge, not the court.

The $408 filing fee is set by Florida statute and is the same in every county. What differs between counties is which of the smaller charges above apply to your case, and whether your clerk adds a card-payment or e-filing convenience fee. Always confirm the current total with your own clerk before you file.

How much is the court filing fee for a divorce in Florida?
$408.00. It is set by Florida statute (§ 28.241) and is the same in every Florida county, for both simplified and regular dissolutions. It is paid to the clerk of court and is non-refundable, even if you reconcile and dismiss the case.
Does the divorce filing fee vary by county in Florida?
No. The $408 petition fee is statutory and identical statewide. What varies is which smaller charges apply to your case — summons preparation and issuance if your spouse must be served, copies, and any card-payment or e-filing convenience fee your clerk adds.
What is the total cost to file, including extras?
If your spouse signs a waiver of service you may pay only the $408 plus a small charge for certified copies. If they must be served, add $7 to prepare and $10 to issue the summons. A missing-spouse divorce also carries a newspaper publication charge set by the paper.
What documents do I need for a Florida divorce?
Every case needs the petition, a financial affidavit from each spouse, the notice of Social Security number, a certificate of compliance with mandatory disclosure, and the final judgment for the judge to sign. If you share property you add a marital settlement agreement, and if you have minor children you add a parenting plan and child support worksheet.
Can I get the filing fee waived?
Florida has an Application for Determination of Civil Indigent Status which the clerk of court can consider. Ask the clerk in your county whether you qualify.
